Attah Ede, Makurdi
The Court of Appeal sitting in Makurdi, Benue State, on Monday, nullified the Benue State All Progressives Congress (APC) Governorship Primaries held on 27th May 2022.
The Court in Appeal No. CA/MK/PE/21/2022 between PROF. TERHEMBA SHIJA V ALL PROGRESSIVES CONGRESS & 2 OTHERS, however, ordered a re-run of the primary in 11 out of the 23 Local Government Areas of the state within 14 days of this judgement.
The affected local government areas include Gwer East, GwerWest, Makurdi, Guma, Tarka, Gboko, Buruku, Vandeikya, Katsina-Ala, Logo and Ushongo.
The three-member panel led by Justice Mohammed Danjuma gave the order while ruling on Appeal No. CA/MK/PE/21/2022 between PROF. TERHEMBA SHIJA V ALL PROGRESSIVES CONGRESS & 2 OTHERS brought by Prof. Terhemba Sjija challenging the lower court decision on the matter.
It would be recalled that the APC governorship primary election in Benue State had earlier produced Rev Father Hyacinth Alia as the Candidate of the Party in the State.
The Appeal court equally dismissed Senator B I Gemade Appeal before the court for lacking in merit for being status barred and upheld the judgement of the lower court.
The appellate court also ruled out APGA from participating in the Governorship Election in Benue state.
